The Legalization of Cannabis in the State of Delaware

Cannabis, also known as marijuana, is a plant that has been used for medicinal and recreational purposes for centuries. In recent years, there has been a growing movement to legalize cannabis in the United States, and many states have already done so. Delaware has legalized marijuana for medicinal purposes, but the state has yet to legalize cannabis for recreational use. Here’s a look at the current state of marijuana legalization in Delaware, and the potential future of cannabis in the state.

The Current State of Marijuana Legalization in Delaware

In 2011, Delaware became the 16th state to legalize marijuana for medicinal purposes with the passage of Senate Bill 17. This law allows patients with certain qualifying conditions to use cannabis for medicinal purposes, and it establishes a system for the cultivation, distribution, and sale of medicinal marijuana.

However, the possession and use of marijuana for recreational purposes remains illegal in Delaware. The possession of small amounts of marijuana is a misdemeanor punishable by up to six months in jail and a fine of up to $1,150. The possession of larger amounts is considered a felony, and the penalties increase significantly.

While Delaware has legalized marijuana for medicinal purposes, the state’s medical marijuana program has been slow to get off the ground. As of 2021, there are only a few dispensaries operating in the state, and many patients are still waiting for the program to fully launch.

The Potential Future of Cannabis in Delaware

Despite the slow rollout of the state’s medical marijuana program, there is growing support for the legalization of marijuana for recreational purposes in Delaware. In a recent poll, 61% of Delaware residents said they support the legalization of marijuana for recreational use. This trend is consistent with national surveys, which have consistently shown that a majority of Americans support the legalization of marijuana.
